Building Information Certificates

If you have illegally constructed a structure or building you may require a Building Information Certificate.

A building information certificate operates to prevent a council, for a period of 7 years from the date of issue of the certificate, from making an order (or taking proceedings for the making of an order or injunction) under the Environmental Planning and Assessment Act 1979 or the Local Government Act 1993 requiring a building or structure to be repaired, demolished, altered, added to or rebuilt.

Waterfront Development

Our firm has extensive experience in the preparation of applications for waterfront development in and adjoining marine and aquatic waterways throughout NSW (above and below the Mean High Water Mark). Watercraft structures include jetties, ramps, pontoons, sliprails, boat sheds and marinas. The requirements for approval of waterfront works in NSW is complex with endorsement required from NSW Fisheries, Roads and Maritime Services (RMS) and Crown Lands prior to the lodgement of a development application at the local council. For waterfront works within Sydney Harbour, RMS provides land owner's consent and is also the consent authority. Our firm can project manage the entire approval process on your behalf until determination.

Our services include:

  • Initial feasibility advice (identification of the Mean High Water Mark, Foreshore Building Line, available water depth and analysis of site constraints)

  • Preparation of all development application documentation (Statement of Environmental Effects)

  • Representation during development assessment by government departments

  • Marine Habitat Surveys

  • Preparation of Crown Licences

  • Part 7 permits under the Fisheries Management Act 1994

Our director holds a masters degree in environmental law and is experienced in Land and Environment Court appeals.

  • Advice on prospects of appeal

  • Expert evidence in NSW Land and Environment Court appeals

  • Preparation of Statements of Facts and Contentions

  • Representation at mediation and conciliation conferences (s. 34 conferences)

Rezoning & Strategic Planning

We prepare and review strategic planning strategies, master plans, Local Environmental Plans (LEPs) and Development Control Plans (DCPs).

Our services include:
